The following terms and conditions (“Terms”) govern your use of this Site. By accessing, viewing, or using the content, material, or services available on or through this Site, you indicate that you have read and understand these Terms, that you agree to them and intend to be legally bound by them. If you do not agree to these Terms, or if you are under 13 years of age, you are not granted permission to use this Site and must exit immediately.
Shipping Policy
Any and all orders placed through the Site are subject to this Shipping Policy. We strive for expedient delivery, and aim to have most packages shipped within 48 hours. While unfortunate, Gansett Outfitters bears no responsibility for the safety or delivery of the products purchased on our website once the package leave our warehouse and has been passed to the carrier — any problems pertaining to the delivery of that package must be resolved between the customer and the carrier in accordance with the carrier’s policies.
Free shipping is available on orders of, or exceeding, $50.00 USD. Available in the Contiguous USA only.
Pricing
The pricing available on this Site is for information purposes only for use by Gansett Outfitters’ customers and potential customers and subject to change/verification. While Gansett Outfitters strives to provide accurate product and pricing information, pricing or typographical errors may occur. Gansett Outfitters cannot confirm the price of any Gansett Outfitters product or service until after an order is placed. In the event that a product or service is listed on the Site at an incorrect price or with incorrect information due to an error in pricing or product information, Gansett Outfitters shall have the right, at its sole discretion, to refuse or cancel any orders placed for that product or service. In the event that a product or service is mispriced, Gansett Outfitters may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Gansett Outfitters’ prices and the availability of Gansett Outfitters products or services are subject to change without notice.
Order Acceptance
Gansett Outfitters reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Among the circumstances that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by Gansett Outfitters’s credit and fraud avoidance staff. Gansett Outfitters may also require additional verifications or information before accepting any order. Gansett Outfitters will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your payment has been received, Gansett Outfitters will issue a credit to your account in the amount of the charge.
Returns and Exchange Policy
Any and all orders placed through GansettOutfitters.com are subject to the following Return and Exchange Policy.
Gansett Outfitters will accept merchandise returns where the merchandise has been unworn, unwashed, and undamaged retaining all of the original tags. All returns must be initiated within 30 days of the original purchase to be eligible for a refund. All returns must include the original packing slip or receipt. The original shipping and handling costs associated with the original order are not eligible for refund.
Refunds will be provided in the same form as the original order’s payment method. We recommend using UPS, Fedex, or other shipping providers which include insurance and tracking information.
Payment
Some products or services on the Site may be available for purchase. Gansett Outfitters uses a third party payment processor to process credit card transactions made through the Site. If you purchase products from Gansett Outfitters or make any payments via the Site with your credit card, the credit card information that you submit to Gansett Outfitters will be protected by encryption, such as with the Secure Socket Layer (“SSL”) protocol. Encryption decreases the likelihood that your credit card information will be stolen or intercepted during transmission to Gansett Outfitters. You are responsible for all charges incurred under your account, whether made by you or another person using your account. If for any reason Gansett Outfitters does not receive payment for a purchase, Gansett Outfitters may exercise its rights in law and equity, including (a) immediately suspending or terminating your account; (b) seeking collection of the outstanding amount owed; and/or (c) seeking legal action against you for the breach of these Terms. You are also responsible for paying any governmental taxes imposed in connection with use of the Site or the purchase or any products or services made available through the Site, including sales, use, and excise taxes (excluding only taxes on Gansett Outfitters’ net income). As between you and Gansett Outfitters, Gansett Outfitters owns or licenses all data, content, graphics, forms, artwork, images, photographs, functional components and any software concepts and documentation and other material on, in or made available through the Site (“Site Materials”), as well as the selection, coordination, arrangement, and organization and enhancement of the Site Materials. Indemnification

You shall have the right to employ separate counsel in any Claim and to participate in the defense thereof. If Gansett Outfitters or its licensors do not notify you that it elects to undertake the defense thereof, you shall have the right to defend the Claim with counsel reasonably acceptable to Gansett Outfitters, subject to the right of Gansett Outfitters to assume, at their sole cost and expense, the defense of any Claim at any time prior to the settlement or final determination thereof.
Internet Security
Gansett Outfitters uses reasonable efforts to ensure that the Site is generally available. However, there will be occasions when access to the Site will be interrupted or unavailable. Gansett Outfitters will use reasonable efforts to minimize such disruption where it is within its reasonable control. You agree that Gansett Outfitters shall not be liable to you for any modification, suspension or discontinuance of the Site. You understand that the technical processing and transmission of any Site content may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Your use of the Site following any changes means that you agree to follow and be bound by the terms as changed. By accessing, viewing, or using the services, works, content, or materials on the Site, you consent and agree to (a) the exclusive jurisdiction of the federal and state courts located in Wakefield, Rhode Island; (b) accept service of process by personal delivery or mail; and (c) irrevocably waive the right to trial by jury and any jurisdictional and venue defenses otherwise available.
